Terms of Service

Welcome to Kuruby Inc! This Agreement applies to all software applications and services made available by Kuruby Inc including, but not limited to, mobile games, downloadable/installable games for handheld devices, personal computing devices or gaming consoles, and games and services accessed by means of a browser or other online communication method (together, the “Services”).

By downloading, accessing, or using the Services, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Services.

1. ACCEPTANCE OF TERMS

By using our Services, you confirm that you are at least the age of majority in your jurisdiction of residence, or if you are under the age of majority (such as under 18), that you have reviewed these Terms with your parent or legal guardian and they have agreed to them on your behalf.

2. LIMITED LICENSE

Subject to your agreement and continuing compliance with these Terms, Kuruby Inc grants you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to access and use the Services for your own non-commercial entertainment purposes. You agree not to use the Services for any other purpose.

3. ACCOUNT CREATION AND SECURITY

To access certain features of our Games, you may be required to create an account.

  • You must provide accurate and up-to-date information.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You are responsible for all activities that occur under your account.

  • You may not share your account or password with anyone, nor let anyone else access your account.

  • Kuruby Inc reserves the right to terminate or suspend your account if we suspect unauthorized use or a violation of these Terms.

4. VIRTUAL CURRENCY AND IN-APP PURCHASES

Our Games may include virtual currencies (such as coins, gems, or tokens) and virtual items (collectively, "Virtual Goods") that can be earned through gameplay or purchased with real-world money.

  • No Real-World Value: Virtual Goods have no real-world monetary value and cannot be exchanged for "real" money, goods, or services from Kuruby Inc or any third party.

  • License Only: When you purchase or earn Virtual Goods, you are obtaining a limited, personal, non-transferable license to use them within the Game. You do not own the Virtual Goods.

  • Final Sales: All purchases of Virtual Goods are final and non-refundable, except where required by applicable law.

  • Pricing and Availability: We reserve the right to manage, regulate, control, modify, or eliminate Virtual Goods at any time, with or without notice. We shall have no liability to you or any third party in the event we exercise such rights.

5. USER CONDUCT

You agree to use the Services lawfully and respectfully. You agree not to:

  • Use the Services to violate any applicable laws or regulations.

  • Engage in any fraudulent, abusive, or illegal activity.

  • Attempt to hack, exploit, reverse engineer, decompile, or otherwise interfere with the Services or our servers.

  • Use cheats, automation software (bots), hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Games.

  • Harass, threaten, or engage in toxic behavior toward other players or Kuruby Inc employees.

  • Buy, sell, trade, or transfer your account or any Virtual Goods to other users or third parties.

6. USER GENERATED CONTENT

If you submit, upload, or post any content, feedback, or suggestions to us or within the Services ("User Content"), you grant Kuruby Inc a worldwide, perpetual, irrevocable, royalty-free, sub-licensable, and transferable right to use, reproduce, modify, adapt, publish, and display such content in connection with the Services.

7. TERMINATION

We reserve the right to suspend or terminate your access to the Services, including deleting your account and any associated Virtual Goods, at our sole discretion, without notice or liability, for any reason, including if we reasonably believe you have violated these Terms.

8. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KURUBY INC MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KURUBY INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and any dispute arising out of or related to them will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of laws principles. Any legal action or proceeding related to these Terms shall be brought exclusively in the courts located in Ontario, Canada.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice within the Services or on our website. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes.
